Terms and Conditions
Payment of the fee confirms the Client’s agreement to these Terms and Conditions and to receive the Services as set out below.
It is mutually agreed that the following Terms and Conditions form an integral part of this Contract between The Photographer and The Client and that no variation or modification of this Contract shall be effective unless accepted by The Photographer and The Client in writing.
Fees: This includes all photography during the photo session, post processing of three images selected by The Photographer and delivery of the three images as a digital download within two weeks of the session. A booking for a Digital Mini Session is reserved only when a non-refundable fee of £33.00 is paid. Due to the nature of Digital Mini Sessions no refunds are available. The delivery of the three digital images shall deem this contract to be fulfilled in its entirety and all obligations discharged. Any subsequent orders for prints must be accompanied by payment In full before any order will be accepted.
License and Coverage: The Photographer shall be granted creative and artistic licence in relation to the choice of locations, poses, photographic style and post processing. The number of images taken will vary and shall be deemed correct, any other images taken will be destroyed. The Photographer cannot be held responsible for any lack of coverage caused by any non co-operation of subjects; nor by restrictions or time constraints placed by any Client arriving late, session times are fixed and cannot be extended. No liability shall be accepted by The Photographer for any specific images and/or poses not photographed.
Copyright: The 1988 Copyright, Designs and Patents Act assigns copyright to Richard Hardwick. Any images or copies of images, whether stored digitally or otherwise, computer files or printed documentation relating to such images are protected by the Act. It is contrary to the Act to copy or allow to be copied photographically, electronically or by any other means an image created as part of this contract without the prior written permission from The Photographer.
Exclusivity: The Photographer shall be the sole photographer for the duration of the photo session, no other photography whether still or video is permitted.
Attendance: Only one person may attend the photo session, no spectators will be permitted during the session.
Insurance & Limitation of Liability: The Photographer will maintain public liability and professional indemnity insurance at all times. In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.
Force Majeure: The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control.
Cancellation: If The Photographer has to cancel this contract, their liability shall be limited to a full refund of all monies paid. The Client may cancel this contract at any time, notice of cancellation must be given in writing to The Photographer and the fee will be forfeited. Where a photo session is postponed until a later date, subject to the alternative date being available, The Photographer will retain any fees paid and confirm the new photo session date and time to The Client.
Complaints Procedure: Please address any complaints to The Photographer by letter or email. The Photographer will endeavour to respond to any complaint within 48 hours.
Use of Images: The Client grants the Photographer permission to use any images from the Digital Mini Session to promote the business in any portfolio and by means of advertising, publicity material, websites, exhibitions, competitions, magazine articles, and other such media.
Data Protection: The Photographer will store your name and details on a private internal database. These details will not be made available to individuals or organisations outside of Hardwick Studio and will be removed after a period of one month.
